Terms & Conditions
These Terms & Conditions ("Terms") govern your access to and use of Casebook (the "Service"), a web and mobile application for logging and reflecting on academic, extracurricular, clinical, volunteering, research, and other experiences. The Service is operated by the owner of Casebook ("Casebook," "we," "us," or "our"). By creating an account, checking the acceptance box, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of 18 (or the age of majority in your jurisdiction), you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms. By using the Service, you represent and warrant that you meet these requirements and that all information you provide is accurate.
2. The Service Is a Personal Record-Keeping Tool
Casebook is an informational and organizational tool that helps you track hours and write personal reflections. The Service is provided for your convenience only. Casebook is not affiliated with, endorsed by, or connected to any school, college, or university (including medical, dental, law, graduate, and undergraduate programs), any application or admissions service (such as AMCAS, TMDSAS, AACOMAS, AADSAS, LSAC / CAS, the UC Application, or the Common Application), or any certification body, employer, hospital, or government agency. We do not verify, certify, validate, or guarantee the accuracy, completeness, or acceptance of any hours, records, or information you store in the Service. You are solely responsible for the accuracy of your records and for independently verifying any information before relying on it for any application, submission, or other purpose.
3. Not Professional Advice
The Service does not provide medical, legal, academic, admissions, career, or other professional advice. Nothing in the Service constitutes a recommendation or guarantee regarding admissions outcomes or any other result. You should consult qualified professionals for advice specific to your situation.
4. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We are not liable for any loss or damage arising from your failure to safeguard your account. You may not share your account, use another person's account, or create an account using false information.
5. Your Content
You retain ownership of the content you create, upload, or store in the Service ("Your Content"). You grant us a limited, non-exclusive, royalty-free license to host, store, process, and display Your Content solely for the purpose of operating and providing the Service to you. You are solely responsible for Your Content and represent that you have all rights necessary to submit it and that it does not violate these Terms or any law or third-party right.
6. Protected Health and Patient Information — Important
The Service is not a HIPAA-covered platform and is not intended to store protected health information ("PHI") or any information that identifies a patient or any other individual. You agree that you will not enter, upload, or store the names, dates of birth, medical record numbers, contact details, images, or any other information that could identify a patient or any third party. You must describe experiences in general, de-identified terms only. You are solely and entirely responsible for any information you choose to enter, and you agree that any consequences arising from your entry of identifying or confidential information are your responsibility alone. We expressly disclaim all liability related to any such information you choose to store in the Service.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose;
- Upload viruses, malicious code, or attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with, disrupt, overload, scrape, or reverse-engineer the Service or its underlying infrastructure;
- Submit content that is unlawful, infringing, defamatory, or that violates the privacy or rights of others;
- Misrepresent your identity or your affiliation with any person or entity.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains what information we collect and how we use it. By using the Service, you consent to the collection and use of your information as described there.
9. Intellectual Property
The Service, including its software, design, branding, logos, and content (excluding Your Content), is owned by Casebook and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written permission.
10. Third-Party Services
The Service relies on third-party providers for hosting, database, and email delivery. We are not responsible for the acts, omissions, availability, or policies of third-party services, and your use of them may be subject to their own terms.
11. Service Availability
We provide the Service on a reasonable-effort basis and do not guarantee that it will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice, and we are not liable to you or any third party for doing so. You are responsible for maintaining your own backups of Your Content.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE ACCURATE OR RELIABLE, OR THAT ANY DATA WILL BE PRESERVED OR FREE FROM LOSS, CORRUPTION, OR UNAUTHORIZED ACCESS. YOU USE THE SERVICE AT YOUR OWN RISK.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CASEBOOK OR ITS OWNER, OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $100.
14. Indemnification
You agree to defend, indemnify, and hold harmless Casebook and its owner, operators, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; (d) your violation of any law or the rights of any third party; or (e) any information, including any patient or identifying information, that you enter into the Service.
15. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by updating the "Last updated" date or notifying you in the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, you and Casebook waive any right to a jury trial and to participate in a class action.
18. General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. These Terms constitute the entire agreement between you and Casebook regarding the Service and supersede any prior agreements.
